SMS marketing compliance simply refers to following the rules and regulations of text messaging as a business as set forth by the FCC. These include guidelines on collecting new opt-ins, offering direct opportunities for subscribers to opt out of receiving your text messaging, and providing clear notification when a subscriber has either opted in or out of your list.
Is text marketing legal? Of course, but just like email, there are rules and regulations that are important to follow. Thankfully, they’re easy to understand and follow.
- Display a clear call-to-action (CTA) in your messaging. Be sure your message recipients know exactly what action you want them to take.
- Text marketing is an opt-in communication method, which means that everyone on your contact list needs to opt-in to receiving text messaging from your business before you can send them messages. Remember to send confirmation messages to everyone who opts into your list.
- Make sure you give your contacts the required guidance on how to opt out of your list at regular intervals. Texting STOP will usually suffice. This allows your contacts to stay in control of the messages they receive.
- Honor and acknowledge all requests to opt out of your list. Mass texting services usually provide enhancements to help keep your list clean when members opt out, but it’s always a good idea to monitor your lists carefully.
It takes time and effort to grow your contact list and to create a connection with your audience—SMS compliance guidelines exist to preserve and protect that value, and text marketing as a whole, from bad actors and poor behavior. But if you need a further incentive to adhere to SMS compliance rules the TCPA has the power to levy fines and penalties of $500-$1500 for every instance of a message sent to people who have not properly opted in to receive those messages.
The TCPA act takes violations very seriously. How seriously? Texting consumers who did not give expressed written authorization to receive your messages can cost you anywhere from $500 to $1,500 per incident.
The CTIA rule known as SHAFT prohibits businesses and organizations from sending content on the topics of sex, hate, alcohol, firearms, and tobacco, represented in the CTIA Short Code Monitoring Handbook as:
- Spam
- Fraudulent or Misleading Messages
- Depictions or Endorsements of Violence
- Adult Content or Other Content That is Inappropriate for the Intended Audience
- Profanity or Hate Speech
- Endorsement of Illegal Drugs or Controlled Substances
This applies to messages and promotions sent as part of your text marketing program. Violating the SHAFT rule could put your business at risk of losing text marketing privileges.
