Rules About Group Messaging
It was already mentioned above that group marketing is a regulated activity. Most of the rules applicable to group messaging - including how to protect the privacy of your customers and how frequently you are allowed to send group marketing messages - are contained within the pages of the Telephone Consumer Protection Act 1991 (TCPA).
Because TCPA covers so many different channels of communication, the Mobile Marketing Association has extracted the rules and regulations relating to group messaging, and condensed them into a Code of Conduct. We highly recommend that you study this publication before starting your first group messaging campaign.
It is also advisable to be aware that network carriers also have their own set of rules. The Cellular Telecommunications Industry Association (CTIA) prohibits the use of group messaging to promote illegal drug use and acts of violence. The carriers will also block delivery of messages containing profanities, pornography and hate speech. Remember also that your group messaging service provider will have their own terms of use with which you must comply.
